Marcatel wants collective actions against Telmex

The telecommunications company has approximately 7 complaints against Telmex; they are requesting collective actions against monopolist companies

The fixed telephone company Marcatel demands to allow citizens and legal persons affected by monopolist practices to made civil demands and associate so as to file collective complaints and transform monopolist actions into crimes.

In an interview with El Semanario Agencia (ESA), Adrian Moreno, legal vice-chairman of Marcatel, mentioned that the company had proposed 6 factors to include in the Federal Competence Law (LFC) they considered it would strengthen Federal Competence Commission (CFC) and would protect companies of specific sectors.

Moreno affirmed that one of collective actions is to boost competence in Mexico is the one of collective actions.

It must be pointed out that last december 10 was unanimously approved by the Senators Chamber the reform of article 17 of the Constitution that will regulate collective actions in Mexico in favor of citizens that are not necessarily affiliated, and of civil associations in all sectors.

Moreno added that so far they have presented 7 complaints against Telephones of Mexico (Telmex), two of them are related with negatives to consolidate Local Service Areas (ASL) and the other is about rejecting interconnections.

About this latter one, he stated that Marcatel has showed great interest for giving service in rural areas that are far from other companies; he added that “in those localities only Telmex has presence, and when Marcatel requests interconnecting its networks, Telmex denies it or simply does not answer, they do it to limit the growth in those localities”.

Moreover, he mentioned that amongst other demands are found those complaints for doing anti-competitive practices by denying links and accesses of users, and other to irregularities in portability process.

In addition, Moreno considered it is necessary to apply economic sanctions against those companies that practice monopolist actions because they transform them into crimes for economic agents and public officials that are supporting these kinds of practices.

Marcatel is a company that offers voice, national and international data with its own infrastructure and fiber optic network with the purpose of reaching rural areas without the presence of other telecommunication companies. (El Semanario Agencia, ESA)
